TERMS OF USE — MUSCLE APP MOBILE APP

These Terms of Use ("Terms") govern access to and use of the Muscle App mobile applicationfor iOS and Android (the "App"), operated by Muscle App(Roberto Carrascoso Jordán), Madrid, Spain ("we," "us," "our"). By creating an account or using the App, you accept these Terms. If you do not agree, do not use the App.

1. THE SERVICE

The App is a fitness application for athletes. With it you can log workouts, track your nutrition and progress, follow routines, browse community recipes, and use the social features (posts, follows, likes, and comments). If you are subscribed to a trainer through our website, the App also lets you follow the plans they assign you and message them.

Muscle App provides the technology platform. Any coaching services are provided by trainers themselves, who are independent professionals, under the website's Terms and Conditions.

2. RELATIONSHIP TO THE WEBSITE TERMS

The App and the website https://www.muscleapp.fit share the same account and the same backend. These Terms govern your use of the App. Anything you contract or use on the website— including paid subscriptions and trainer services — is governed by the website's Terms and Conditions. In case of conflict regarding the use of the App, these Terms prevail.

3. ACCOUNTS AND ELIGIBILITY

To use the App you must:

• Be at least 18 years old (or the age of legal majority in your jurisdiction, if higher)
• Provide true, accurate, and complete information when registering
• Keep your login credentials secure and not share your account with others
• Be responsible for all activity that occurs under your account

You must notify us promptly at support@muscleapp.fit if you suspect unauthorized use of your account. You can delete your account at any time from the App (Settings → Account).

4. PRICE OF THE APP

The App is currently free of chargeand contains no in-app purchases. If we introduce paid features in the App in the future, we will announce them and their conditions before you can buy anything, and we will update these Terms. Subscriptions offered on our website are contracted there under the website's Terms and Conditions.

5. NO MEDICAL ADVICE

You use the App and follow any training or nutrition program at your own risk. Stop exercising and seek medical attention if you feel pain, dizziness, or discomfort. Nutrition information obtained by scanning barcodes comes from third-party databases and may be inaccurate or incomplete; always check the product label.

6. CONTENT AND INTELLECTUAL PROPERTY

6.1 Our platform

The App, its software, design, logos, and branding are the property of Muscle App and are protected by intellectual property laws. These Terms do not grant you any right over them beyond the personal, non-transferable right to use the App.

6.2 Your content

Content created by users (workouts, photos, posts, messages, profile information) belongs to its authors. By uploading content, you grant Muscle App a non-exclusive, worldwide, royalty-free license to host, store, display, and process that content solely to operate and provide the Services. This license does not allow us to sell your content or use it for advertising without your consent.

You warrant that your content does not infringe third-party rights or applicable law.

7. USER CONTENT AND ACCEPTABLE USE

You may not:

• Use the App for any unlawful, fraudulent, or harmful purpose
• Harass, abuse, or discriminate against other users
• Impersonate another person or misrepresent your identity or credentials
• Upload content that is illegal, dangerous, or infringes third-party rights
• Attempt to breach, probe, or circumvent the security of the platform
• Scrape, copy, or resell the App or its content without authorization

The App includes tools to protect yourself from other users: you can block any user from their profile, and you can report content or behavior that violates these Terms by writing to support@muscleapp.fit. We review reports and may remove content and suspend accounts that break these rules.

8. SUSPENSION AND TERMINATION

You may close your account at any time. We may suspend or terminate your account, with notice where reasonably possible, if you materially breach these Terms, engage in fraudulent or unlawful conduct, or put the platform or other users at risk. Where the breach can be remedied, we will give you a reasonable opportunity to remedy it first.

Upon termination, your right to use the App ends. Provisions that by their nature should survive (intellectual property, limitation of liability, governing law) survive termination. Deletion of your personal data is governed by the App's Privacy Policy.

9. APP STORES

You download the App from the Apple App Store or Google Play. Their own terms apply in addition to these Terms. Apple and Google are not a party to these Terms, are not responsible for the App or its content, and have no obligation to provide support or maintenance for it. To the extent required by the app stores' terms, Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

10. DISCLAIMERS AND LIMITATION OF LIABILITY

We provide the App with reasonable care and skill, but we do not guarantee that it will be uninterrupted, error-free, or that it will meet your specific goals (including fitness results).

To the maximum extent permitted by law:

• Muscle App is not liable for the services, content, or conduct of other users or trainers, who act as independent persons or professionals.
• Muscle App is not liable for indirect damages, loss of profits, or loss of data arising from the use of the App.
• Our total liability to you for claims arising from the App is limited to the amounts you paid us in the 12 months preceding the event giving rise to the claim.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for willful misconduct or gross negligence, or consumers' statutory rights.

11. CHANGES TO THESE TERMS

We may modify these Terms. When we make material changes, we will notify you with reasonable advance notice through the App or by email. If you do not agree with the new Terms, you may close your account before they take effect; continued use after that date constitutes acceptance.

12. GOVERNING LAW AND JURISDICTION

These Terms are governed by the laws of Spain. Any dispute arising from these Terms or the App shall be submitted to the courts of Madrid, Spain, except where you are a consumer and mandatory consumer protection rules give you the right to bring or defend claims before the courts of your place of residence.

13. PRIVACY AND CONTACT

The processing of your personal data in the App is governed by the App's Privacy Policy.
